7Please review these Terms & Conditions carefully as they govern your enrolment at Foxie Pole Dance & Fitness Studio (FPD). You will be required to fill out a Terms & Conditions entry form before enrolling at FPD.
Release and Waiver of Liability
Pole dancing and physical exercise can be strenuous and subject to risk of serious injury, therefore FPD strongly advises that you seek medical advice if you have any doubts as to whether your physical suitability and/or any pre-existing conditions may affect your participation in the classes and/or activities organised by FPD. Any classes and/or activities organised by FPD that you undertake are done so voluntarily and entirely at your own risk and therefore it would be unreasonable for FPD to be responsible for any injury, illness or death. This waiver and release of liability includes, without limitation, all injuries and/or loss of property that may occur as a result of:
Your slipping and/or falling while in the building, or on the premises, including adjacent sidewalks and parking areas.
Your use of all amenities and equipment in the studio and your participation in any class, activity or workshop.
The sudden and unforeseen malfunctioning of any equipment.
Our instruction, training, or supervision.
Conduct
You must at all times follow the instruction of our instructors for your own safety and the safety of other students/participants. Students who repeatedly disobey instructions may be asked to leave the class/activity.
Strictly No Alcohol
FPD takes safety seriously and with this in mind No Alcohol is to be consumed during any Pole Instructional Class/or booked event given at FPD. In the event of a Hens/Girls Party or any other booked event at FPD there will be NO Alcohol served or consumed by any participant in the class.
FPD recommend that NO Alcohol be consumed, by any student/participant, prior to any Pole Instructional Class or any other Instructional Class at FPD, including any/all participants in a Hens/Girls Party‚ or any booked event held at FPD.
FPD will not be held responsible for any injury or death as a result of a participant/non-participant being intoxicated prior to entry to FPD. FPD reserves the right to restrict entry to any person thought to have consumed alcohol prior to entry to FPD.
Intellectual Property
FPD reserves the rights in all intellectual property, including but not limited to any moves, tricks, routines, course style and structure taught in any classes/activities conducted or organised by FPD. You must not use or exploit any intellectual property owned by FPD for personal financial gain in any manner, including but not limited to instructing or teaching pole dancing, without first obtaining the written permission of FPD proprietors. You will not video or record any routines unless authorised to do so by FPD proprietors and will under no circumstances share/post videos of FPD choreographed routines on the internet or to the general public.
Strictly No CHILDREN
As per the OH&S guidelines children are not permitted to attend/watch a class for the safety of themselves and the students.
Refund Policy
These terms set out your rights and obligations with respect to your enrolment and payment including important limitations and conditions to your right to obtain a refund.
Refunds, or the transfers of fees to another term, will not be granted in any circumstances except for:
Cancellation at the discretion of FPD
FPD reserves the right to change or cancel a class up to and including the date of the course if sufficient bookings have not been received. In the event of a class or course being altered or cancelled every effort will be made to avoid inconvenience by offering alternative dates and times. If we are unable to offer a suitable alternative course, a full refund will be given at the discretion of FPD.
Deposits
A $70 deposit is required at the time of booking with the balance payable on Week 1 of your first class in order to secure your place in the course. Deposits paid prior to the commencement of the start date are transferable but are not refundable.
Catch-Up Classes
FPD strongly recommends that you attend all of your booked classes. We are unable to specifically schedule catch up classes for individuals. However, in the event that you are unable to attend the class that you enrol in, a maximum of 2 catch up classes will be offered in an alternative class of equivalent value (subject to availability). All catch up classes MUST be taken in the same term and cannot be transferred/rolled over to another term.
Gift Vouchers
In the event of Pregnancy
FPD does not recommend that you participate in pole dancing whilst pregnant. In the event of an unexpected pregnancy a full refund of your deposit will be given only if written notice is provided 14 days prior to the commencement of the course date. If the course has been paid for in full a complete refund will be given only if written notice is provided 14 days prior to the commencement of the course date. Where notice is given with less than 14 days notice prior to commencement of the course date and full payment has been made FPD will at their discretion offer a non-transferable credit valid for 12 months
Participants of a Minority Age
If you are under 18 parental consent is required and we ask that a parent or legal guardian attends the studio to sign a waiver and consent form prior to the commencement of your first class. Minimum age is 16 at our discretion.

Please be sure that you have read and understood these Terms & Conditions prior to paying a deposit to Foxie Pole Dance & Fitness Studio (FPD) or signing the waiver form, as this constitutes your agreement to the application of these policies.

- If a student has to cancel attendance due to ill health. In this instance a credit for the remaining value to be used within 12 months will be issued. Written notice and a medical certificate that confirms sickness or incapacity must be provided. This remains at the discretion of FPD.
- If FPD have to cancel a course. See below.

- A Gift Voucher can not be exchanged for cash
- A Gift Voucher issued as a credit note is non transferable
- A Gift Voucher must be used by the expiration date and can be exchanged for goods or services to the value of the gift voucher
